Notarization, Apostille and Translation of Powers of Attorney for China

Hello.
I am Taiga Sato, an administrative scrivener in Minato City, Tokyo.

Authentication Required for a Power of Attorney Submitted in Mainland China

Since November 7, 2023, a public document issued in Japan that falls within the scope of the Convention may be certified for submission in mainland China with an apostille obtained in Japan; consular authentication by the Embassy or a Consulate-General of China in Japan is no longer required. Please confirm the requirements for the document concerned and the receiving authority.

A power of attorney prepared by an individual or company is generally a private document. It proceeds through notarization, certification of the notary’s seal by the Director of the Legal Affairs Bureau, and then an apostille from Japan’s Ministry of Foreign Affairs. At notary offices in Tokyo, a one-stop service combining these steps may be available at the applicant’s request.

An apostille certifies the authenticity of signatures, seals, and similar formalities; it does not guarantee the contents of the power of attorney or its acceptance by the receiving authority in China. The documents required to engage our office may differ from those required by the receiving authority. Before engaging us, please confirm the required format, wording, validity period, Chinese translation, and any additional documents with that authority.

Translations carry risks such as spelling errors, so we recommend engaging an office with a reliable double-checking process.
(We are aware of cases at other firms where spelling errors required procedures to be redone.)

Turnaround Time: Apostille Acquisition for Powers of Attorney (Authorization Letters / Entrustment Letters) for China

After a formal engagement, we complete the translation within three business days, excluding weekends and Japanese public holidays.

We then obtain the apostille at the notary office within a further three business days, excluding weekends and Japanese public holidays, and dispatch the documents to your requested address.

How the Service Works

  1. First, e-mail the data for the power of attorney for which you would like to obtain an apostille to info@royal-ptns.com.
  2. We will send you an estimate by e-mail covering the fees and turnaround time.
    Please note: as a rule, we reply within 24 hours, excluding weekends and Japanese public holidays.
  3. If you decide to proceed, please make payment in advance.
    Bank transfer and credit-card payment are available.
  4. Please mail the signed power of attorney to our office. Please use Letter Pack Light or a similar service and send it to the address below.
    We recommend Letter Pack Light: Letter Pack Plus requires face-to-face delivery and may take longer if nobody is available to receive it.

  5. Within three business days excluding weekends and Japanese public holidays, we will arrange apostille acquisition at the notary office and dispatch the original documents to your requested address.
    At that time, we will also send PDF scan data by e-mail.

Frequently Asked Questions

Are any documents required in addition to the power of attorney?
Unless the receiving authority requires, for example, that the principal sign a declaration (声明书 / Declaration), no other documents are required beyond the signed power of attorney you send to us. If your Chinese name and Japanese name differ, however, a family register certificate or a copy of your passport may be required.
Do I need to go to the notary office myself?
If you engage our office, you do not need to visit the notary office. An administrative scrivener will visit to arrange apostille acquisition on your behalf.
If notarization and an apostille are required for a copy of a Japanese passport, you do not need to visit the notary office if you mail us the original passport. (The original passport must be presented at the counter to process an apostille for a passport copy.)

Important Notes

If you have become a naturalized Japanese citizen and have both a Japanese name and a Chinese name, you may need to prove that they refer to the same person.
In that case, attaching a Simplified Chinese translation of your Japanese family register certificate and a copy of your Japanese passport, and declaring that they refer to the same person, may enable the power of attorney (authorization letter / entrustment letter) to be used in China. Please confirm the receiving authority’s requirements.
